Welcome to Backyard Par. By booking or using our services, you agree to the following Terms of Service.
1) Services Provided
- Mobile golf simulator rental: delivery, setup, operation, and breakdown at your event location.
- Primary service area: Los Angeles, Orange County, Inland Empire, and Ventura counties (travel fees may apply).
2) Booking & Payment
- A 50% non-refundable deposit is required to confirm your booking.
- The remaining balance is due on the day of the event.
- Taxes and any applicable travel fees are added at checkout.
- If day-of payment terms are not met, Backyard Par may decline to proceed and treat the booking under the Cancellation & Refund Policy.
3) Event Requirements
- Flat, outdoor space: 16’ W × 20’ D × 11’ H, plus clearance on one long side for safe entry/exit.
- One standard power outlet within 75 feet.
- Client secures access, safe conditions, and any permits.
- Typical setup: 45–60 minutes. Takedown: 30–45 minutes.
4) Liability
Assumption of Risk: Participants acknowledge golf/simulator play involves physical activity with inherent risks. By booking, the client and guests voluntarily assume all associated risks.
Release: Backyard Par (owners, employees, contractors) is not liable for injuries, illnesses, accidents, property damage, or other losses during or after the event, except in cases of gross negligence or willful misconduct by Backyard Par.
Client Responsibility: The client must (i) ensure a suitable, safe, and compliant location; (ii) supervise guests; (iii) ensure minors are supervised by a responsible adult; (iv) prevent intoxicated/impaired use; and (v) cover repair/replacement costs for damage to Backyard Par equipment caused by negligence, misuse, vandalism, or unsafe site conditions.
Indemnification: The client agrees to indemnify, defend, and hold harmless Backyard Par from claims, damages, or expenses (including attorney’s fees) arising from guest injuries, third-party/property damage, violations of these Terms, or unlawful/unsafe actions at the event.
5) Weather Policy
For safety, events may be rescheduled due to heavy rain, high wind, or unsafe conditions. If rescheduling isn’t possible, see the Cancellation & Refund Policy below.
6) Cancellation & Refund Policy
- 7+ days before event: Full refund (minus processing fees, if any).
- 3–6 days before event: 50% refund.
- Within 48 hours of event: Non-refundable.
- Deposit: All deposits are non-refundable but may be applied to a future booking if cancellation occurs at least 7 days before the event.
- Weather: If unsafe weather prevents setup, we’ll reschedule at no cost. If rescheduling isn’t possible, a full refund including the deposit will be issued.
- No-Show / Site Not Ready: If the client is unavailable, access is denied, or the site is unsuitable (space/power/safety), the booking is treated as a no-show and is non-refundable.
- Refund Method: Returned to the original payment method within 7–10 business days.
7) Governing Law
These Terms are governed by California law; disputes are resolved in San Bernardino County, CA.
